These Terms of Use ("Terms") govern your use of the InciSmart mobile app ("the app", "we", "us"), a skincare ingredient analysis app operated by Ieva Jonaityte, an individual developer based in the United Kingdom. By downloading, accessing, or using InciSmart, you agree to these Terms. If you do not agree, please do not use the app. For questions, contact support@incismart.co.uk.
1. Eligibility
You must be at least 13 years old to use InciSmart. By using the app, you confirm that you are 13 or older. If you are under the age of majority in your country, you should review these Terms with a parent or guardian.
2. Your account
You sign in using Google or Apple. You are responsible for keeping access to your sign-in method secure and for activity that occurs under your account. Notify us at support@incismart.co.uk if you believe your account has been used without your permission.
3. Licence to use the app
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use InciSmart for your own personal, non-commercial use, in line with these Terms and the rules of the app store you downloaded it from. You may not copy, modify, reverse-engineer, resell, or distribute the app or its content except as allowed by law.
4. Subscriptions and payments
InciSmart may offer optional paid subscriptions. Payments are processed by the app store you downloaded the app from (for example Google Play or the Apple App Store), not by us, and are subject to that store's terms.
Subscriptions renew automatically for the applicable billing period until you cancel. Any free trial converts to a paid subscription unless you cancel before it ends.
You can manage or cancel a subscription in your Google or Apple account settings. Refunds are handled by the relevant app store under its refund policy.
5. Your contributions
If you submit products or ingredient lists to the shared product database, you grant us a worldwide, royalty-free licence to store, use, adapt, and display that content as part of the app and its database. Contributions are linked only to a random anonymised ID and are not tied to your name or email. You must only submit content you are entitled to share, and it must be accurate to the best of your knowledge.
6. Acceptable use
You agree not to misuse the app. In particular, you must not: use the app for any unlawful purpose; upload false, misleading, or infringing content; attempt to gain unauthorised access to our systems or other users' data; interfere with or disrupt the app or its security; or use automated means to scrape or extract data from the app.
7. Intellectual property
The app, its design, branding, and content (other than user contributions and third-party materials) belong to us or our licensors and are protected by intellectual property laws. These Terms do not transfer any ownership rights to you.
8. Not medical advice
InciSmart provides ingredient information and product comparisons for general informational purposes only. It does not provide medical advice and is not a substitute for professional guidance. Always consult a qualified professional about skin conditions, allergies, or reactions. You use the information in the app at your own discretion and risk.
9. Third-party services
The app relies on third-party services, including Google Firebase and the app stores through which it is distributed. Your use of those services is subject to their own terms and policies. We are not responsible for third-party services we do not control.
10. Availability and changes
We may update, change, or discontinue the app or any of its features at any time, and we may set limits on certain features. We aim to keep the app available but do not guarantee uninterrupted or error-free operation.
11. Disclaimers
The app is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the ingredient data, matches, or dupes are complete, accurate, or suitable for your particular needs.
12. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, or consequential loss, or for any loss arising from your reliance on ingredient information or product comparisons in the app. Nothing in these Terms limits liability that cannot be excluded by law, including for death or personal injury caused by negligence. If you are a consumer, you keep all statutory rights that cannot be waived.
13. Termination
You may stop using the app at any time and delete your data using the in-app option. We may suspend or end your access if you breach these Terms or misuse the app. Sections that by their nature should survive termination will continue to apply.
14. Changes to these terms
We may update these Terms from time to time. If we make material changes, we will notify you in the app or by email before they take effect. Continuing to use the app after the changes take effect means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of England and Wales. If you are a consumer, you may also be entitled to the protection of mandatory consumer laws of the country where you live, and you can bring claims in the courts there.
