These Terms of Use ("Terms") govern your use of the InciSmart mobile app ("the app", "we", "us"), a skincare app focused on ingredient analysis, operated by Ieva Jonaityte, an individual developer based in the United Kingdom. By downloading, accessing, or using InciSmart, you agree to these Terms and our privacy policy. If you do not agree, please refrain from using the app. For questions, contact support@incismart.co.uk.
1. Eligibility
You must be at least 13 years old to use InciSmart. By using the app, you confirm that you are 13 or older. If you are under the age of majority in your country, you should review these Terms with a parent or guardian.
2. Your account
You sign in using Google or Apple. You are responsible for maintaining the security of your sign-in method and for any activity under your account. Notify us at support@incismart.co.uk if you believe your account has been accessed without your permission.
3. Licence to use the app
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use InciSmart for your own, personal, non-commercial use, in accordance with these Terms and the rules of the app store from which you downloaded it. You may not copy, modify, reverse-engineer, resell, or distribute the app or its content unless permitted by law.
4. Subscriptions and payments
InciSmart is free to download and use. The free tier includes full access to core ingredient analysis, subject to weekly usage limits. InciSmart Premium is an optional paid subscription that removes those limits and unlocks additional features.
Price and billing period. InciSmart Premium costs £1.99 per month in the United Kingdom and US$2.49 per month, plus any applicable sales tax, in the United States. Prices are shown in your local currency in the app before you confirm purchase and may vary by country or region. Prices may change; we will give you notice of any price increase and the opportunity to cancel before it takes effect, as required by the app store's rules.
How payment is taken. Payment is charged to your Apple ID account (or, on Android, your Google account) at confirmation of purchase. Payments are processed by the app store from which you downloaded the app, rather than by us, and are subject to that store's terms. We never receive or store your card or payment details.
Automatic renewal. Your subscription renews automatically for the applicable billing period unless you cancel it. Your account will be charged for renewal within 24 hours prior to the end of the current period, at the price for the applicable renewal period. Auto-renewal can be turned off at any time.
Managing and cancelling. You can manage your subscription and turn off auto-renewal in your Apple ID account settings (Settings → your name → Subscriptions on iOS) or your Google account settings on Android, at any time after purchase. To avoid being charged for the next period, you must cancel at least 24 hours before the end of the current period. Cancelling stops future renewals; your subscription remains active until the end of the period you have already paid for.
Refunds. No refund is given for the unused portion of a current billing period when you cancel, except where required by law. Refunds are handled by the relevant app store according to its refund policy, not by us. If you are a UK or EU consumer, your statutory cancellation and refund rights are unaffected by this paragraph.
Free trials and introductory offers. Where a free trial or introductory offer is available, its length and terms are shown in the app before you subscribe. A free trial converts automatically into a paid subscription unless you cancel at least 24 hours before the trial ends. Any unused portion of a free trial is forfeited when you purchase a subscription to that content, where such an offer applies. Free trials and introductory offers may be limited to new subscribers and may not be available in all regions.
5. Feedback and product requests
If you send us feedback or ask us to add a product, you allow us to use your suggestion to improve the app without any obligation to you. We decide which products to add to the database, and we may not be able to add every product requested.
6. Acceptable use
You agree not to misuse the app. Specifically, you must not: use the app for any unlawful purpose; submit false, misleading, offensive, or infringing content, including in feedback; attempt to gain unauthorised access to our systems or other users' data; interfere with or disrupt the app or its security; circumvent usage limits or subscription features; or use automated means to scrape or extract data from the app.
7. Intellectual property
The app, its design, branding, and content (excluding third-party materials) are owned by us or our licensors and are protected by intellectual property laws. These Terms do not transfer any ownership rights to you. Product names, brands and trademarks shown in the app belong to their respective owners; showing them does not imply any affiliation with or endorsement by them.
8. Not medical advice
InciSmart provides ingredient information and product comparisons for general informational purposes only. It does not provide medical advice and should not be considered a substitute for professional guidance. Always consult a qualified professional regarding skin conditions, allergies, or reactions. You use the information in the app at your own discretion and risk.
9. Product information and AI analysis
Ingredient safety ratings are derived from the European Commission's CosIng database and are updated with app releases. Product information, including ingredient lists and typical prices, is compiled from brands, retailers, and other public sources, and may be incomplete, out of date, or differ from the product you buy; always check the label on the product itself. Text read from a photo may contain recognition errors. AI analysis is generated automatically by a third-party AI model and may be inaccurate or incomplete.
10. Third-party services
The app relies on third-party services, including Google Firebase, Anthropic (for AI analysis), and the app stores through which it is distributed. Your use of those services is subject to their own terms and policies. Some product pages link to Amazon; these are affiliate links, and we may earn a commission on purchases made through them at no extra cost to you. Purchases you make from Amazon or any other retailer are between you and that retailer. We are not responsible for third-party services that we do not control.
11. Availability and changes
We may update, change, or discontinue the app or any of its features at any time, and we may impose limits on certain features. While we aim to keep the app available, we do not guarantee uninterrupted or error-free operation.
12. Disclaimers
The app is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the ingredient data, matches, dupes, or AI analysis are complete, accurate, or suitable for your particular needs.
13. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, or consequential loss, or for any loss arising from your reliance on ingredient information, product comparisons, or AI analysis provided by the app. Nothing in these Terms limits liability that cannot be excluded by law, including for death or personal injury caused by negligence. If you are a consumer, you retain all statutory rights that cannot be waived.
14. Termination
You may stop using the app at any time and delete your account and data using the in-app option (Profile → About the App → Delete account and all data). We may suspend or terminate your access if you breach these Terms or misuse the app. Sections that, by their nature, should survive termination will continue to apply.
15. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you in the app or by email before they take effect. Continuing to use the app after changes means you accept the updated Terms.
16. Governing law
These Terms are governed by the laws of England and Wales. If you are a consumer, you may also be entitled to the protection of mandatory consumer laws in your country, allowing you to bring claims in its courts.

18. Additional terms for users who download InciSmart from the Apple App Store
This section applies only if you obtained InciSmart from the Apple App Store, and applies in addition to the Terms above. Where this section conflicts with another section of these Terms, this section prevails for App Store users.
(a) Acknowledgement. These Terms are concluded between you and Ieva Jonaityte only, and not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for InciSmart and its content. These Terms do not provide for usage rules for InciSmart that conflict with the Apple Media Services Terms and Conditions as of the effective date of these Terms.
(b) Scope of licence. The licence granted to you in Section 3 is a non-transferable licence to use InciSmart on any Apple-branded products that you own or control, and as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions, except that InciSmart may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
(c) Maintenance and support. We are solely responsible for providing any maintenance and support services for InciSmart, as specified in these Terms or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services in respect of InciSmart. Support requests should be sent to support@incismart.co.uk.
(d) Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of InciSmart to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to InciSmart, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be our sole responsibility.
(e) Product claims. We, not Apple, are responsible for addressing any claims by you or any third party relating to InciSmart or your possession and/or use of it, including but not limited to: (i) product liability claims; (ii) any claim that InciSmart fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
(f) Intellectual property rights. In the event of any third-party claim that InciSmart or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of any such claim.
(g) Legal compliance. You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and that you are not listed on any U.S. Government list of prohibited or restricted parties.
(h) Developer name and address. Questions, complaints or claims with respect to InciSmart should be directed to: Ieva Jonaityte, United Kingdom, support@incismart.co.uk.
(i) Third-party terms of agreement. You must comply with applicable third-party terms of agreement when using InciSmart.
(j) Third-party beneficiary. You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary of them.
